Copyright Policy

  1. COPYRIGHT POLICY. This “Copyright Policy” is subject to the Wizness Terms of Use, found here. All capitalized terms not defined in this Copyright Policy have the same definitions assigned to them in the Terms of Use.


    1. No infringement: User represents that User owns or has the complete and unfettered right to share any and all the information that the User shares on the Wizness Platform. User guarantees to Company that information shared will not infringe the rights of a third party.

    1. No Confidential Information: Ideas and information shared on the Wizness Platform may be seen and used by other Users, Company does not guarantee that other Users will not use the ideas and information shared. Users therefore represents that information shared is not confidential in nature.


    1. License Grant: User grants Company a non-exclusive, transferable, irrevocable, worldwide, perpetual, unlimited, assignable, sub-licensable, royalty-free right to any information that User posts on, or submits to the Wizness Platform. Company may prepare derivative works, copy, improve, distribute, publish, remove, retain, add, analyze, use, and commercialize that information, in any way known or in the future discovered, without further notice, consent, or compensation to User or any third party.


    1. User Generated Content: Certain Company Applications allow User’s to generate reports or other materials based on information inputted by the User within the Company Application. The User may publish the content created by User using the Application. The User understands and accepts that any information or report made public may be publicly accessible via the Internet and may be indexed and identified by search engines. The User is responsible for ensuring that User does not make publicly available confidential or private content.

    1. Disclaimer for Accuracy of User-Generated Content. User is solely responsible for the accuracy and completeness of all data inputted into Company Applications. If the User inputs false, inaccurate or incomplete information into a Company Application, this may lead to false, inaccurate or incomplete reports or materials of any kind. The Company shall in no event be responsible for the content of any User-generated reports or any other materials generated by using the Platform.


    1. 4.1 User Indemnity: User shall indemnify, release and hold Company, its parents, affiliates, subsidiaries, and their respective directors, officers, shareholders, employees and agents, harmless from all claims, damages, losses, and costs (including, but not limited to reasonable attorneys’ fees and costs) in any way related to or arising out of the information shared by User on the Wizness Platform.


    1. Notice of Copyright Infringement. Company has implemented procedures for receiving written notifications of claimed infringements. If User believes in good faith that information on the Wizness Platform infringes a copyright, User may provide a written communication to Company that contains:

      1. An electronic or physical signature of the person authorized to act on behalf of the copyright owner;

      2. a description of the copyrighted work in which User claims infringement;

      3. a description specifying the location on the Wizness Platform of the material that you claim is infringing;

      4. User’s telephone number and address;

      5. a statement made by User that User has a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

      6. a statement, made under penalty of perjury, that the information in User’s notice is accurate and that:

        1. User is the copyright owner; or

        2. User is authorized to act on the copyright owner’s behalf.

    1. Counter-Notice of Copyright Infringement. User may submit a Counter Notice, to the address specified above. User may provide a written communication that contains:

      1. User’s physical or electronic signature;

      2. identification of the material removed;

      3. a statement that User has a good faith belief that the removal of the material was a mistake or that the material was misidentified;

      4. User’s name and telephone number; and

      5. a statement that you consent to the jurisdiction the courts of Paris, France.
